1 Plaintiffs in Error, Kenneth Rider and Daryl Parker, hereafter referred to as defendants, were convicted by a jury verdict in the District Court of Osage County, case no. CRF 69-677, with the crime of Burglary in the Second Degree, and punishment was fixed at five (5) years imprisonment. Judgment and sentence was imposed on Defendant Parker on April 7, 1970, and judgment and sentence was imposed on Defendant Rider on April 10, 1970, and from said judgments this appeal has been perfected.
